Agreement to these Terms

These Terms and Conditions form the agreement governing use of the HoopingNow mobile application, website and related services, together called the Service. HoopingNow is an early-stage public-beta basketball community service based in the United Arab Emirates and made available in the UAE and other countries.

By creating an account, selecting the acceptance control, accessing or using the Service, a user confirms that they have read, understood and agreed to these Terms and the Privacy Policy. A person who does not agree must not create an account or use the Service.

Eligibility and worldwide availability

Users must be at least 18 years old and have legal capacity to enter into this agreement. The Service is not intended for minors. Account and age information must be accurate.

The Service may be accessed from the UAE and other countries where it is offered. Each user is responsible for complying with the laws that apply in their location. Availability does not represent that every feature, game, venue or external payment arrangement is lawful or suitable in every country. HoopingNow may restrict, localize or discontinue access for legal, sanctions, safety, licensing, technical or store-distribution reasons.

What HoopingNow provides

HoopingNow is a community technology platform that helps adult basketball players discover courts, games and tournaments; create or join games from 1v1 to 5v5; organize activities; maintain profiles; record attendance, scores and results; and receive ratings or community recognition.

Unless HoopingNow expressly identifies itself as the organizer of an official activity, games and tournaments are created and managed by users or independent third parties. HoopingNow is not the owner, manager or operator of a court or venue and is not a party to arrangements made directly between users, hosts, organizers, venues or providers.

HoopingNow does not guarantee that a game will occur, that a court is available or safe, that a user will attend, that teams will be balanced, or that user-provided information, scores, ratings, prices or venue details are accurate.

User accounts

• Provide accurate and current account information.
• Keep credentials confidential and control access to the device.
• Use only one authentic personal account unless HoopingNow approves otherwise.
• Report suspected unauthorized access to support@hoopingnow.com or through the support method displayed in the App.
• Remain responsible for activity performed through the account, except to the extent caused by HoopingNow's breach of applicable law.

HoopingNow may request reasonable verification for trust, safety, fraud prevention, event eligibility or legal compliance. Unless a verified indicator is expressly displayed, HoopingNow does not represent that it has verified a user's identity, skill, background, experience or fitness.

Profiles, ratings and results

Profiles, levels, positions, ratings, badges, statistics and rankings are community and product features. They may be based on user information, game results, attendance, organizer input, participant feedback and automated calculations. They are not professional certifications and may be incomplete, subjective or disputed.

Users must submit honest scores, attendance and ratings. Fake ratings, manipulated results, duplicate accounts, impersonation and retaliation through reviews are prohibited. HoopingNow may correct, remove or recalculate information that appears inaccurate, abusive or manipulated.

Creating, joining and organizing games

Host and organizer responsibilities

A host or organizer is responsible for providing accurate details, confirming venue access, obtaining required permission or booking, communicating changes, managing capacity, setting fair conditions, following venue requirements and taking reasonable safety precautions.

An organizer must not present an event as sponsored, insured, approved or operated by HoopingNow unless HoopingNow confirms this in writing.

Participant responsibilities

Participants are responsible for reviewing details, arriving on time, following lawful organizer and venue rules, behaving safely and respectfully, and informing the organizer if they cannot attend.

Cancellations and changes

Games may be changed or cancelled because of weather, venue availability, insufficient players, organizer decisions, safety concerns or other circumstances. Organizers should update listings promptly. HoopingNow may remove a listing that appears unsafe, misleading, unlawful or inconsistent with these Terms.

HoopingNow is not responsible for travel costs, court fees, lost time or other expenses caused by a user-organized cancellation, no-show or inaccurate listing, except where liability cannot lawfully be excluded.

Offline fees and payments

The HoopingNow App and its current digital features are free. HoopingNow does not collect a commission or process payments between players, hosts, organizers or venues. If a host, court, tournament or provider charges a participation or venue fee, the host must disclose the amount, currency, what it covers, payment timing, cancellation and refund terms before a player commits.

Any payment is made outside the App and directly between the player and the relevant host, venue or provider. HoopingNow does not request or store bank or card details; receive, hold, route or safeguard funds; issue receipts, credits or refunds; guarantee payment or performance; resolve chargebacks; or act as merchant, marketplace seller, payment provider, escrow agent, trustee, broker or agent.

Players must check the payee's identity, price, currency, refund terms and legitimacy before paying. Hosts and providers are responsible for pricing, collections, receipts, refunds, taxes, permits, records and legal compliance. Payment disputes remain between the payer and the relevant host, venue, provider or payment provider, subject to mandatory law.

An offline payment must never unlock digital content, App functionality, subscriptions, boosts, badges, rankings or another digital benefit. If paid digital features are introduced later, HoopingNow will use the billing method required by the applicable app store and will update the legal documents before launch.

Physical activity and safety

• Decide whether you are medically and physically able to participate and obtain medical advice when needed.
• Inspect the playing surface, hoop, surrounding area, lighting and weather before play.
• Use appropriate footwear and protective equipment and remain hydrated.
• Follow venue, organizer and emergency instructions.
• Do not participate while impaired or when a condition makes play unsafe.
• Do not use the App while driving or when device use would create danger.
• Contact the appropriate local emergency service for urgent assistance; HoopingNow is not an emergency service.

To the extent permitted by applicable law, users voluntarily accept the ordinary and inherent risks of participating in user-organized basketball activities. Nothing in these Terms excludes liability that cannot legally be excluded.

Location, maps and venues

Location, map, distance, route, opening-hour and venue information may be supplied by users or independent providers and may be inaccurate or outdated. Users must verify venue access, booking, rules, suitability and travel routes independently and should share only the location information necessary for the activity.

User Content

Before creating or uploading User Content, users must accept these Terms and the Community Standards. Users retain ownership of their photos, videos, text, listings, comments and other submissions and represent that they own or have the permissions needed to use them.

By submitting User Content, a user grants HoopingNow a non-exclusive, worldwide, royalty-free, transferable and sublicensable licence to host, store, reproduce, format, adapt, display, distribute and communicate that content only as reasonably necessary to operate, secure, moderate, improve and promote the Service. The licence ends when the content is deleted from HoopingNow's systems, subject to routine backups, lawful retention, content already shared with others and separately approved promotional use.

Before posting a recognizable photo or video of another person, a user must have an appropriate legal basis and any consent required by law. Requests not to be filmed or to remove content should be respected.

Community Standards

Users must not use the Service to:

• Harass, threaten, bully, stalk, discriminate against, defame, exploit or endanger another person.
• Post pornography, sexual solicitation, hate content, graphic violence, unlawful material or content contrary to applicable public-order or public-morals laws.
• Publish another person's private information, location, communications, images or recordings without a lawful basis.
• Impersonate another person, misrepresent affiliation, create fake events, manipulate ratings or commit fraud.
• Promote unsafe challenges, violence, illegal gambling, controlled substances or criminal activity.
• Infringe copyright, trademark, image, publicity, confidentiality or other rights.
• Spam users, scrape profiles, harvest contact details or use the Service for unauthorized commercial solicitation.
• Introduce malware, probe security, bypass access controls, overload systems or interfere with another user's experience.
• Use bots or unauthorized automation to create accounts, join games, manipulate results or collect information.
• Violate venue rules, organizer rules, sporting requirements or applicable local law.

Reporting, blocking and moderation

The App provides tools to report objectionable content, games and users and to block abusive users. Urgent platform concerns may also be submitted to support@hoopingnow.com or through the support method displayed in the App. Immediate danger or suspected crime should be reported to the competent local authority or emergency service.

HoopingNow may review, restrict, remove or preserve content; warn, suspend or terminate accounts; cancel listings; limit features; and cooperate with lawful authority requests. Action may be taken without prior notice where reasonably necessary for safety, legal compliance, evidence preservation, service security or prevention of further harm.

HoopingNow does not undertake to monitor every interaction and cannot guarantee that objectionable conduct will never occur. A non-emergency moderation decision may be appealed through the support method displayed in the App or by emailing support@hoopingnow.com.

Intellectual property

The Service, software, designs, branding, logos, text, graphics and interfaces provided by HoopingNow, excluding User Content and identified third-party material, are protected by applicable intellectual-property laws.

HoopingNow grants each user a personal, limited, revocable, non-exclusive and non-transferable licence to install and use the App on permitted devices for lawful, non-commercial use of the Service.

Privacy and third-party services

The Privacy Policy explains how personal data is handled. The Service may include maps, social sign-in, venue links or other independent services. Their own terms and privacy policies apply, and HoopingNow is not responsible for their independent acts or omissions.

Public-beta availability

The Service is under active testing and may contain errors, incomplete functions or interruptions. HoopingNow may add, change, suspend or discontinue features, subject to applicable law. Users are responsible for compatible devices, operating-system updates, internet access and carrier charges.

Suspension and account deletion

Users may stop using the Service and request permanent account deletion through the account or privacy controls provided inside the App.

HoopingNow may restrict, suspend or terminate an account where it reasonably believes the user breached these Terms, created a safety or legal risk, engaged in fraud or abuse, manipulated community features, or exposed the Service or other users to harm.

Disclaimers and limitation of liability

To the fullest extent permitted by applicable law, the public-beta Service is provided on an as-is and as-available basis. HoopingNow does not warrant uninterrupted availability; the identity, conduct, skill, safety or attendance of users; the quality or safety of games, courts or venues; or the accuracy of User Content, ratings, maps, prices or external links.

To the fullest extent permitted by law, HoopingNow will not be liable for indirect, incidental, special, consequential, exemplary or punitive loss arising from user-organized games, user conduct, venue conditions, external payments or independent services.

Where liability may lawfully be limited and HoopingNow is found liable, aggregate liability arising from the free Service and these Terms will be limited to AED 500. This does not limit a mandatory consumer right or liability that cannot legally be excluded, including liability for fraud, wilful misconduct, gross negligence, or death or personal injury where limitation is prohibited.

App store terms

If the App is downloaded from Apple App Store or Google Play, the applicable store terms also apply. These Terms concern the user and HoopingNow, not the store operator. HoopingNow is responsible for the App and its support, subject to these Terms and applicable law.

The store operator has no obligation to provide maintenance or support and is not responsible for claims relating to the App except where its own terms or applicable law expressly require otherwise. To the extent required by store terms, the store operator and its subsidiaries may enforce the relevant app-store provisions as third-party beneficiaries.

Governing law and disputes

These Terms and related non-contractual obligations are governed by the federal laws of the United Arab Emirates and, where applicable, the laws in force in the Emirate of Dubai. This choice of law does not remove any mandatory consumer protection or other right that cannot legally be waived under the law of the user's country.

A user should first submit a written description of a dispute to support@hoopingnow.com or through the support method displayed in the App and allow a reasonable opportunity for resolution. If the dispute is not resolved, the courts of Dubai, United Arab Emirates will have jurisdiction, except where mandatory consumer or other applicable law gives the user the right to use another competent authority, dispute-resolution body or court.

Changes to these Terms

HoopingNow may update these Terms as the public beta develops, the law changes or the business model evolves. The updated version will show a new effective date and material changes will receive reasonable notice. Users may be required to accept updated Terms before continuing to use the Service.
